By placing an order with Johnny’s Trucking LLC (“Company”), you (“Customer”) acknowledge and agree to the following terms and conditions:

1. Service & Product Availability
   All services and products are subject to availability. The Company reserves the right to refuse or cancel orders at its sole discretion, including but not limited to situations where services cannot be performed due to weather, road conditions, or equipment failure.
2. Payment Terms
   All payments must be made in accordance with the terms specified in the invoice or service agreement. Failure to pay may result in additional fees, interest charges, or suspension of services. Returned checks or failed electronic payments will incur additional fees.
3. Limitation of Liability
   Johnny’s Trucking LLC is not liable for any direct, indirect, incidental, or consequential damages arising from delays, service interruptions, or product defects beyond its reasonable control. In no event shall the Company’s total liability exceed the amount paid by the Customer for the affected service or product.
4. Delivery Terms
   Customers are responsible for providing accurate delivery details and ensuring access to the delivery site. Johnny’s Trucking LLC is not responsible for damages resulting from inaccessible sites or inaccurate information provided by the Customer.
5. Force Majeure
   The Company shall not be held liable for any failure to perform due to circumstances beyond its control, including but not limited to natural disasters, strikes, labor shortages, accidents, or governmental restrictions.
6. Warranties & Representations
   Except as explicitly stated in a written agreement, Johnny’s Trucking LLC makes no warranties, express or implied, regarding the quality, performance, or suitability of its products or services.
7. Indemnification
   Customer agrees to indemnify and hold harmless Johnny’s Trucking LLC, its officers, employees, and agents from any claims, damages, losses, or liabilities arising out of or related to the use of the Company’s services or products.
8. Governing Law
   This disclaimer and any transactions with Johnny’s Trucking LLC shall be governed by and construed in accordance with the laws of the state in which the Company operates.
